An agreement with CDSL for e-voting is a written permission, from CDSL, to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change resolutions on "the Site".
CDSL has taken reasonable care to make sure that the information appearing on the web site is accurate and up to date. However, errors and omissions do occur and you should not take the accuracy of the information for granted. Because we do not have control over the use to which the information should be put, we exclude any warranty, express or implied, as to the quality, accuracy, timeliness, completeness, performance, fitness for a particular purpose of the web site or any of its contents. We will not be liable for any damages (including without limitation damages for loss of profit, revenue or anticipated savings) arising in contract, tort or otherwise from the use of or inability to use the web site or any of its contents or from any action taken (or refrained from being taken) as a result of using the web site or any such contents. We make no warranty that the contents of the web site are free from infection by viruses or anything else which has contaminating or destructive properties.
It is our policy to respond to notices of alleged infringement that comply with the Indian Copyright Act. Responses to these notices may include removing or disabling access to E-Voting Website including Hyperlinks, for websites claimed to be involved in infringing activity, and/or terminating accounts. CDSL will make a good-faith attempt to contact the owner or administrator of the affected website so that they may make a counter notification pursuant to the Indian Copyright Act.
CDSL respects the intellectual property rights of others and require that Site users do the same. To file a notice of infringement, you must provide a written communication (by certified mail) that sets forth the items specified below (including section numbers):
CDSL retains the content of electronic submissions, applications, e-mails or other use of the "Contact us" portions of this Site, including the e-mail address from which the transmission was sent and responses thereto in order to handle any follow-up. By using this site, a user is deemed to have provided the user's permission to the collection and use of information for the purposes set out herein.
CDSL reserves the right to change this privacy statement at any time(s) without prior notice by posting a modified privacy statement on the site.
The administrator of an affected website may make a counter notification pursuant to the Indian Copyright Act. When we receive a counter notification, we may reinstate access to the e-Voting services for the website in question.
In relation to any legal action or proceedings against CDSL in a Court of law or other Tribunal regarding any matter connected or related to use or access of this web site, all persons accessing this web site irrevocably submit to the exclusive jurisdiction of the Courts of Mumbai and waive any objection to such proceedings on grounds of venue or on the grounds that the proceedings have been brought in an inconvenience forum. The governing law in such legal proceedings referred to above shall be the laws of the Republic of India.
